Terms & Conditions of the "Win A BMW 128i Convertible Draw"

Bavarian Motor Cars GmbH Car 2012 Draw Official Rules, Terms and Conditions

The Win a BMW 128i ConvertibleDraw 2012 (the "draw" or "the raffle") is conducted by Bavarian Motor Cars GmbH (a privately held company) - an official partner of the BMW Military Sales Program.

The draw will benefit the U.S. military community in Europe and is offered only in Europe. No official U.S. Army endorsement is implied.

The Raffle is open only to U.S. I.D. Card holders stationed in Europe and winner must be 18 years or older at the time of entry.

Your information will be verified and entered in our database to receive promotional material. You can elect to withdraw from the database at anytime which implies your withdrawal from the draw.

No purchase is necessary to enter the draw, but you must be eligible to purchase through the tax-free BMW Military Sales Program under the SOFA (Status of Forces) agreement.

The Raffle begins on October 2nd, 2011 and ends on September 15, 2012.

One raffle entry per household. All raffle ticket and electronic raffle ticket entries are final.

The Raffle prize winner will be drawn on or after October 2nd, at Bavarian Motor Cars GmbH Military event in Garmisch-Partenkirchen, Edelweiss Lodge , Germany.

The winner will receive a 2012, BMW 128i Convertible, White, MSRP $34,660. The prize includes a home shipping voucher to the USA.

No prize substitution or cash equivalent of prize is offered.

Winner does not need to be present to win. The will be notified by email from the information provided on the ticket stub and/or online form when ticket was submitted.

The winner has 15 calendar days from drawing to claim prize. In the event the winner is non-compliant with requirements, or if prize notification is returned as undeliverable, prize will be forfeited and an alternate winner selected at random.

To claim the prize, the winner must provide I.D. card, PCS orders and a valid driver's license that matches name on selected ticket stub or printed verification.

The winner must be entitled to make a tax-free purchase under the SOFA (Status of Forces) agreement at the time of entry, at the time of the draw, and at the time of delivery of the prize.

Winner must take delivery of automobile from Bavarian Motor Cars GmbH Military Sales & Delivery Center on a date agreed upon by the winner and Bavarian Motor Cars GmbH.

The winner is responsible for the cost of travel to and from the delivery center.

Winner must provide valid I.D. Card, PCS orders, driver's license, social security number, vehicle registration and license plates, and evidence of legally required insurance at time of delivery.

The prize is given over to the winner in the same way as a tax-free vehicle purchase and as such will clear customs through MWR . Additional paperwork will be required to process this and the winner is required to sign this paperwork to confirm their right to a tax-free purchase (though there is no cost of the vehicle to the winner). This paperwork is also required to be signed by a senior officer that is known to the prize winner to confirm their declaration.

The automobile is provided "as is" and is not exchangeable for fair market value. To the maximum extent permitted by applicable law, Bavarian Motor Cars GmbH disclaims all warranties with respect to the automobile.

Winner is solely responsible for all other costs incurred in claiming, and using the automobile, including, without limitation, costs associated with state registration, taxes and emissions upon return to the USA.

All applicable taxes and/or additional expenses and proof of insurance associated with the prize are the responsibility of the winner.

The Winner is soley responsible in informing the IRS of their prize and the value of the prize if required.

By participating, entrants consent to the collection, processing and use of the information provided to the Bavarian Motor Cars GmbH in conjunction with the raffle for promotion, and any other purpose it sees fit, including the use of this information for marketing purposes by the Bavarian Motor Cars GmbH and publicity release. Failure to do so will render winner ineligible to receive prize.

Entering the draw adds entrants details to the Bavarian Motor Cars database to receive monthly promotional material. These details can be removed from this mailing list and the draw at any time by selecting the "unsubscribe" button included on the emails sent.

If for any reason the Bavarian Motor Cars GmbH "Win a BMW 128i Convertible Draw" 2012 is not capable of being conducted as planned, including any causes beyond the control of the administrators of the raffle, Bavarian Motor Cars GmbH reserves the right, at its sole discretion, to cancel, modify, suspend or terminate the raffle without notice to the participants.

Bavarian Motor Cars GmbH is the final authority on all issues. The conduct and decision of Bavarian Motor Cars gmbH is final and no correspondence will be entered into.

All participants agree to abide by the terms of these Official Rules and by the decisions of Bavarian Motor Cars GmbH.

By participating, the entrants agree to release and hold harmless Bavarian Motor Cars GmbH, as well as any directors, officers, employees or contractors of these organizations from any and all liability for any injuries, loss or damage of any kind arising from or in connection with this raffle.

Released parties are not responsible for any incorrect or inaccurate information, including, without limitation, that which is caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Raffle or by any technical or human error which may occur in the processing of entries in the Raffle.

Released parties assume no responsibility for any error, omission, interruption, deletion, or defection, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of web site or entries in processing the Raffle entries.

Released parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of email or entrants on accounts of technical problems or traffic computer on-line systems, servers, or providers, computer equipment, software, failure of email or entrants on accounts of technical problems or traffic congestion on the Internet or at any web site associated with the Raffle.

Released parties are not responsible for user cheating or fraud by any entrants.
